END-USER LICENCE FOR B-LOGICA SOFTWARE. IMPORTANT – READ CAREFULLY:

End User License Agreement (the “License”) is a legally binding agreement between you (whether you are an individual or a legal entity) and B-LOGICA relating to any B-LOGICA software product, which includes computer software and may include related storage media, printed materials and direct (“online”) or electronic documentation (“SOFTWARE PRODUCT”).

Any software provided with the SOFTWARE PRODUCT that has a separate end user license is granted under the terms of this license. If you install, copy, download, access or otherwise use the SOFTWARE PRODUCT, you agree to the terms of this License and are bound by them. If you do not agree to the terms of this License, do not install or use the SOFTWARE PRODUCT. You can, however, return it to the point of sale where you purchased it for a full refund.

LICENCE TO USE A SOFTWARE PRODUCT

The SOFTWARE PRODUCT is protected by international copyright laws and treaties, as well as other related laws and treaties. Only the license to use the SOFTWARE PRODUCT is granted. The SOFTWARE PRODUCT is not for sale.

1. GRANTING OF A LICENCE

This License grants you the following rights *:

Application Software. You may install, use, access, display, perform or otherwise work (“EXECUTION”) with a copy of the SOFTWARE PRODUCT or any previous version of the SOFTWARE PRODUCT for the same operating system only on one computer workstation.

Additional licences. You may install and use the software product on more than one computer only if you have obtained for each computer the corresponding license of the SOFTWARE PRODUCT from B-LOGICA or from an authorized partner (reseller).

Storage / Network Use. You may also store or install a copy of the SOFTWARE PRODUCT on a storage medium, such as a network server, to be used only to RUN the SOFTWARE PRODUCT on your other COMPUTERS over an internal network. However, you must obtain and dedicate one License for each COMPUTER on which the SOFTWARE PRODUCT is executed from the storage media. A license for the SOFTWARE PRODUCT may not be shared or used simultaneously on different COMPUTERS.

* Safeguarding of rights. B-LOGICA reserves all rights not expressly granted.

2. DESCRIPTION OF OTHER RIGHTS AND RESTRICTIONS

• Software not intended for resale. You have no right to resell or generally transfer the SOFTWARE PRODUCT, regardless of what is stated in other sections of this License. Excluded are the company’s partners (resellers) upon specific written agreement.
• Restrictions on Reverse Engineering and Decompilation and Disassembly of source or object code. You may not reverse engineer, decompile or disassemble the source or object code of the SOFTWARE PRODUCT, except and only to the extent that such activities are expressly permitted by applicable law notwithstanding the above limitation.
• Separation of component parts. The License applies to the SOFTWARE PRODUCT as a single product. It is not allowed to separate its component parts for use in more than one COMPUTER.
• Trademarks. This License does not grant you any rights with respect to any trademarks of B-LOGICA products or services.
• Lease. Leasing, renting or lending the SOFTWARE PRODUCT is prohibited.
• Support Services. B-LOGICA may provide you with support services in connection with the SOFTWARE PRODUCT (“Support Services”). Use of the Support Services is subject to B-LOGICA’s policies and established programs as described in the user manual, direct (“online”) documentation and/or other materials provided by B-LOGICA. Any additional software code provided to you as part of the Support Services will be considered part of the SOFTWARE PRODUCT and will be subject to the terms and conditions of this License. With respect to the technical information you provide to B-LOGICA for Technical Support purposes, B-LOGICA has the right to use it for business purposes, including product support and development. B-LOGICA will not use this technical information in a way that discloses your identity.

3. UPDATES.

If the SOFTWARE PRODUCT is marked as an upgrade version, in order to be entitled to use it, you must have the required license for the product identified by B-LOGICA as an upgradeable product. A SOFTWARE PRODUCT marked “Upgrade” replaces and/or supplements (and may disable) the product that formed the basis of your rights to use this upgrade. You may use the resulting upgraded product only in accordance with the terms of this License. If the SOFTWARE PRODUCT is an upgrade of a component part of a software package for which you have been licensed to use as a single product, the SOFTWARE PRODUCT may only be used and transferred as part of that single product package and may not be separated for use on more than one COMPUTER.

4. INTELLECTUAL PROPERTY.

All title rights in the SOFTWARE PRODUCT (including, but not limited to, images, photographs, animations, videos, sounds, music, text and applets embedded in the SOFTWARE PRODUCT), the accompanying printed materials and any copies of the SOFTWARE PRODUCT, as well as the intellectual property rights in all of the above, belong to B-LOGICA or its suppliers. All title and intellectual property rights contained in the content that can be accessed through the use of the SOFTWARE PRODUCT are the property of the respective content owner and may be protected by applicable intellectual property or other copyright laws and conventions. This License does not grant you any right to use this content. If this SOFTWARE PRODUCT contains documentation that is provided only in electronic form, you are permitted to print a copy of this electronic documentation. You may not reproduce the printed material accompanying the SOFTWARE PRODUCT.

5. SOFTWARE ON TWO STORAGE MEDIA.

You may receive the SOFTWARE PRODUCT on more than one storage media. Regardless of the type or size of storage media you receive, you are only allowed to use storage media that is suitable for your unique COMPUTER. You may not EXECUTE the software from the other storage medium to another COMPUTER. You may not lend, lease, rent or otherwise transfer the other storage media to another user, except in the context of a final transfer (as defined above) of the SOFTWARE PRODUCT.

6. SECURITY BACKUP.

After installing a copy of the SOFTWARE PRODUCT in accordance with this License, you may retain the original storage medium on which the SOFTWARE PRODUCT was provided to you by B-LOGICA only for back-up or archival purposes. If the original storage medium is required for the use of the SOFTWARE PRODUCT on the COMPUTER, you have the right to make a copy of the SOFTWARE PRODUCT only for back-up or archival purposes. Except as expressly provided in this License, you may not otherwise make copies of the SOFTWARE PRODUCT or the printed materials accompanying the SOFTWARE PRODUCT.

7. SCOPE OF RESPONSIBILITY

B-LOGICA , although it has checked the fidelity and quality of the program, does not provide any guarantee for the fidelity and any errors of the Software Product and is not liable in any case to the customer for any direct or indirect damage or harm due to or related to the use or inability to use the Software Product. B-LOGICA does not guarantee the completeness of the information contained in the program, nor the absolute accuracy of the information. The client, recognising the possibility of error or omission, must cross-check and verify the information obtained with original sources. (Any liability of the manufacturer and its representatives is limited to the value of the Software Product).

THE COMPETENT COURTS FOR THE SETTLEMENT OF ANY DISPUTE RELATING TO THE INTERPRETATION AND APPLICATION OF THIS AGREEMENT SHALL BE THE COURTS OF ATHENS.

LIMITED WARRANTY. WITH RESPECT TO THE LIMITED WARRANTIES AND SPECIAL PROVISIONS APPLICABLE IN THE SPECIFIC JURISDICTION IN WHICH YOU ARE LOCATED, PLEASE REFER TO THE WARRANTY SHEET INCLUDED IN THIS PACKAGE OR INCLUDED IN THE PRINTED MATERIALS ACCOMPANYING THE SOFTWARE PRODUCT.
